These terms and conditions (“Terms”) and our Privacy Policy set forth herein shall govern your (“I” “Users”, “you”, “your”) usage of all our e-commerce platforms providing optical products and accessories such as sunglasses, frames, optical lens, contact lens, lens cleaning products (“Products”) and home care services like home try-onthrough website, applications for mobile, or any other software (“Eyeconic Opticals LLC”) operated by Eyeconic Opticals LLC or its affiliates and subsidiaries and is hereinafter referred to as (“Company”, “we”, “us”, “our”).

These Terms set out the basis upon which you (“Users”, “you”, “your”) can access and use Eyeconic Opticals LLC in the United Arab Emirates, to buy Products and have them delivered to you (“Services”).

These Terms, include, and are supplemented by, other terms and conditions contained within the Platform that are more specific to the use of particular parts of this Platform and completely replaces any prior agreements, if any, between you and us. In the event of any inconsistency, the terms and conditions specific to a part of the Platform prevail.

BY ACCESSING THE Eyeconic Opticals LLC YOU ARE ENTERING INTO A LEGALLY BINDING AGREEMENT TO THESE TERMS OF USE AND THE PRIVACY POLICY SUCH AS SIGNING A PAPER CONTRACT AND COMPLETELY REPLACES ANY PRIOR AGREEMENTS, IF ANY, BETWEEN YOU AND US. IF YOU DO NOT AGREE WITH AND ACCEPT THESE TERMS OF USE AND PRIVACY POLICY, KINDLY REFRAIN FROM USING THE SERVICE.

By accessing Eyeconic Opticals LLC, you agree to be bound by these Terms. If you do not agree with any of the Terms, your sole recourse is to stop using Eyeconic Opticals LLC immediately.
The Company may amend these Terms at any time without prior notification by posting an updated version of the Terms on Eyeconic Opticals LLC. The Company encourages you to check Eyeconic Opticals LLC regularly for any amendments to the Terms. The Company shall not be held liable for any failure to notify of changes in the Terms. Your continued use of Eyeconic Opticals LLC will constitute your express consent to these Terms.

Nothing in these Terms affects your statutory rights, either as a consumer of services or otherwise as prescribed under the applicable law.

Location

You hereby certify that you are physically located in the state you choose/have chosen as your current location. You acknowledge that your ability to access and use Service is conditioned upon the truthfulness of this certification and that the physicians you access are relying upon this certification in order to interact with you. In the event that your certification is inaccurate, you agree to indemnify Eyeconic Opticals LLC Facilities and the physicians you interact with from any resulting damages, costs or claims as set forth in the indemnification section below.

Privacy Policy

The personal information you provide in the course of using Eyeconic Opticals LLC will be used in accordance with our Privacy Policy, the terms of which are hereby incorporated into and form part of these Terms.

They are simply present to help Eyeconic Opticals LLC analyze data about customer preferences that help Eyeconic Opticals LLC to customize the website for your future visits. Your Details

You will need to register with Eyeconic Opticals LLC to use any Services. The Company shall reserve the right to reject service if it is not satisfied that there is adequate authority or the source provided is not authentic.

By registering yourself on Eyeconic Opticals LLC, you warrant that the details you provide to the Company are correct and complete and you agree that you will inform the Company immediately of any changes to those details (e.g. change of email or postal address). You can access and update your details using the “My Account/My Profile/Equivalent Functionality” area of Eyeconic Opticals LLC. You authorise us to use any information provided to us to verify your information (including any updated information), to obtain an initial credit authorisation from your credit card issuer at the time of registration, at Company’s sole discretion. Your application for registration is dependent on acceptance of the same by Company, in its sole discretion.

You are responsible for maintaining the confidentiality of your account username and password and for preventing unauthorised access to your profile. You agree to accept responsibility for all activities that occur under your account. Please take all necessary steps to ensure that your username and password is kept confidential and secure. Please inform the Company immediately if you have any reason to believe that your username and/or password has become known to anyone else, or are being, or are likely to be, used in an unauthorized manner.

The Company reserves the right to refuse access to Eyeconic Opticals LLC, terminate accounts, remove or edit content, or cancel/reject orders, at Company’s sole discretion at any time. If the Company cancels an order, it will be without charge to you. If an order is cancelled by you, there may be a delivery charge applicable if the order is processed or appointment is booked or delivery personnel is on his or her way for delivery.
